Terms & Conditions of Sale
These Terms & Conditions apply to purchases made from Highgate Contemporary Art, whether through our website or directly with the gallery.
Please read them carefully before making a purchase.
Highgate Contemporary Art is operated by Highgate Art Ltd, a company registered in England and Wales under company number 09923669.

Throughout these Terms, “we”, “us” and “our” refer to Highgate Art Ltd trading as Highgate Contemporary Art.
1. The Artwork
Unless otherwise stated, artworks offered for sale by Highgate Contemporary Art are original works of art.
We either own the artwork or are authorised by the artist or owner to sell it.
We make every reasonable effort to ensure that descriptions, dimensions, materials, framing information and other details shown on our website are accurate.
Measurements are approximate and minor variations may occur.
Colours and appearance may also vary slightly depending on photography, lighting and the screen or device on which an artwork is viewed.
Additional photographs, videos and condition information are available on request.
2. Availability
Original artworks are unique and generally available as single items.
Placing an artwork in your basket does not reserve it.
An artwork remains available for purchase until an order has been successfully completed and accepted by us.
In the unlikely event that an artwork has already been sold or is otherwise unavailable when you place an order, we will contact you and refund any amount paid.
3. Orders
When you place an order through our website, you are making an offer to purchase the artwork subject to these Terms & Conditions.
You will receive an electronic confirmation after placing your order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
an artwork is no longer available;
there has been an obvious pricing or listing error;
payment cannot be authorised;
we are unable to complete any legally required customer verification; or
we are unable to fulfil the order for another reasonable reason.
If we cancel an order after payment has been taken, we will refund the amount paid.
4. Prices
Artwork prices are shown in pounds sterling unless otherwise stated.
Any applicable VAT is included where required.
Delivery charges are calculated separately and added at checkout.
For international orders, additional import duties, taxes, customs charges or other local charges may apply. These are not included in the artwork or delivery price and are the responsibility of the purchaser.
5. Payment
Payment must be made using one of the payment methods offered at checkout or another method agreed directly with Highgate Contemporary Art.
Available payment methods may include debit or credit card, PayPal, Apple Pay, Klarna and Clearpay.
Where a third-party payment or instalment provider is used, your use of that service is also subject to the provider's own terms and eligibility requirements.
An artwork will not normally be dispatched until payment has been received or authorised as required.
For purchases agreed directly with the gallery, separate payment arrangements may be agreed in writing.
6. Payment Plans
Where payment by instalments is offered directly by Highgate Contemporary Art, the artwork will normally remain our property until the agreed purchase price has been paid in full.
Specific payment dates and arrangements will be confirmed separately in writing.
Payment services provided by Klarna, Clearpay or other third parties are governed by the terms of those providers.
7. Delivery
We deliver artworks throughout the UK and internationally.
Delivery charges are calculated and added at checkout and may vary depending on the size, weight, destination and delivery requirements of the artwork.
We will take reasonable care to ensure artworks are appropriately packed for transport.
Delivery times given by us are estimates unless we specifically agree otherwise.
If there is likely to be a significant delay, we will contact you.

8. International Orders
Customers purchasing from outside the United Kingdom are responsible for checking any import requirements that apply in their destination country.
Import duties, customs charges, sales taxes, local taxes and similar charges imposed outside the UK are the responsibility of the purchaser.
Highgate Contemporary Art is not responsible for delays caused by customs procedures or for charges imposed by authorities in the destination country.
Where export documentation or licences are legally required for an artwork, we may need to obtain these before the artwork can be dispatched.
9. Risk and Ownership
Legal ownership of an artwork passes to you once we have received full payment for it.
For consumer deliveries arranged by us, responsibility for loss or damage normally passes to you when the artwork is delivered into your physical possession or to a person identified by you to receive it.
If you independently appoint a carrier that we have not offered or arranged, responsibility may pass at an earlier stage as permitted by law.
Nothing in this section limits your statutory consumer rights.
10. Returns and Cancellation
If you are purchasing as a consumer online or through another distance-selling method, you normally have the right to cancel your purchase within 14 days of receiving the artwork, without giving a reason.
You must notify us within that 14-day period if you wish to cancel.
After notifying us, the artwork must be returned within the applicable legal period.
Please contact us before returning any artwork so that the return can be arranged safely.
UK Returns
For UK orders, Highgate Contemporary Art will normally arrange and cover the cost of returning the artwork.
International Returns
For international orders, the purchaser is responsible for arranging and paying for the safe return of the artwork.
We strongly recommend that international returns are sent using an appropriate tracked and insured service.
The artwork should be returned in the condition in which it was received and should be carefully repackaged using its original packaging wherever reasonably possible.
Once the artwork has been returned, refunds will be processed in accordance with applicable consumer law.
Where your statutory cancellation right applies, we will refund the price paid for the artwork together with the cost of our standard outbound delivery service. If you chose a more expensive delivery service, the additional cost of that enhanced service may not be refundable.

11. Commissions and Bespoke Works
Artworks commissioned or created specifically to your requirements are bespoke goods.
Once work on a bespoke commission has begun, the order cannot normally be cancelled or returned simply because you change your mind.
Any commission deposit, payment schedule, timescale and specific requirements will be agreed separately.
Nothing in this section affects your legal rights where an artwork is faulty, damaged or not as described.
12. Damaged, Faulty or Incorrect Artwork
We carefully inspect artworks before dispatch.
If an artwork arrives damaged or you believe that it is faulty or materially different from its description, please contact us as soon as reasonably possible at info@highgateart.com.
Please retain the packaging and provide photographs of the artwork and packaging where appropriate.
Your statutory rights under consumer law are not affected by these Terms.
13. Condition of Original Artworks
Original artworks may contain characteristics resulting from the artist's materials, methods and working process.
Texture, surface variation, visible brush or palette-knife marks, irregularities and other characteristics may form an intentional part of an artwork rather than constitute defects.
Where reasonably requested before purchase, we are happy to provide further photographs, videos or information about the condition and surface of an artwork.
14. Statements About Artworks
Information concerning an artwork's artist, title, date, medium, dimensions, provenance, condition or other characteristics is provided in good faith using the information available to us.
Where matters involve artistic attribution, dating, provenance or expert opinion, such information may sometimes reflect professional judgement rather than an absolute statement of fact.
Nothing in these Terms excludes or restricts liability for fraudulent misrepresentation or affects any rights you have where goods are not as described.
15. Copyright
Purchasing an artwork transfers ownership of the physical artwork to you but does not transfer copyright or other intellectual-property rights unless this is expressly agreed in writing.
Copyright will normally remain with the artist or other copyright owner.
You may not reproduce an artwork for commercial publication, merchandise or other commercial purposes without permission from the relevant copyright owner.
Highgate Contemporary Art and/or the artist may continue to use photographs or other images of an artwork after it has been sold, including for archival, editorial, promotional and marketing purposes.
16. Website Images and Room Mock-Ups
Images showing artworks within interiors, including room mock-ups and visualisations, are intended to help illustrate scale, atmosphere and placement.
They are illustrative only.
While we make reasonable efforts to represent artwork size, colour and appearance accurately, differences in screen display, photography, perspective and room dimensions mean that these images should not be relied upon as exact representations.

17. Studio Viewings
Viewings may be available by appointment at our North London studio.
Where an artwork is viewed in person before purchase but the final contract is subsequently concluded online or remotely, the legal status of the transaction will depend on the circumstances in which the contract is formed.
Nothing in these Terms limits any statutory rights that apply.
18. Anti-Money Laundering
Highgate Contemporary Art may be required by law to carry out identity or customer due-diligence checks in connection with certain art transactions.
Where such checks are required, we may request identification or other information before completing a transaction, accepting payment, transferring ownership or releasing an artwork.
We may be unable to complete a transaction until any legally required checks have been satisfactorily completed.
19. Gift Cards
Gift cards purchased from Highgate Contemporary Art may be subject to additional terms shown at the time of purchase.
Gift cards cannot normally be exchanged for cash except where required by law.
Any expiry date or specific restrictions applicable to a gift card will be stated when it is purchased.
20. Trade and Interior Designer Purchases
Where an artwork is purchased wholly or mainly for business purposes, including some purchases by interior designers, businesses or other trade clients, statutory consumer rights may not apply.
Any separate trade terms agreed in writing will take precedence where they conflict with these Terms.
21. Our Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
If you are purchasing as a consumer, nothing in these Terms affects your statutory rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer.
Where you purchase in the course of a business, our liability may be subject to additional limitations agreed with you separately.
22. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform our obligations where this results from circumstances outside our reasonable control.
This may include transport disruption, customs delays, extreme weather, fire, flood, industrial action, interruption of essential services or other events that could not reasonably have been prevented.
If such an event materially affects your order, we will contact you and take reasonable steps to minimise the effect.
23. Personal Information
We use personal information in accordance with our Privacy Policy.

24. Changes to These Terms
We may update these Terms & Conditions from time to time.
The terms applying to your purchase will normally be those in force when your order was placed, unless a change is required by law.
25. Governing Law
These Terms & Conditions are governed by English law.
If you are a consumer, you retain any mandatory rights and protections available to you under applicable consumer law.
Nothing in these Terms prevents a consumer living elsewhere in the UK from bringing proceedings in a court available to them under applicable law.
For business purchases, the courts of England and Wales will have exclusive jurisdiction unless otherwise agreed in writing.
